{"id":863,"date":"2026-09-01T00:24:24","date_gmt":"2026-09-01T00:24:24","guid":{"rendered":"https:\/\/eplusrmarketing.co\/?page_id=863"},"modified":"2026-09-01T00:25:23","modified_gmt":"2026-09-01T00:25:23","slug":"terms-of-service","status":"publish","type":"page","link":"https:\/\/eplusrmarketing.co\/index.php\/terms-of-service\/","title":{"rendered":"Terms of Service"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-page\" data-elementor-id=\"863\" class=\"elementor elementor-863\">\n\t\t\t\t<div class=\"elementor-element elementor-element-0b5af5c e-flex e-con-boxed e-con e-parent\" data-id=\"0b5af5c\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-358790b elementor-widget elementor-widget-text-editor\" data-id=\"358790b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>EPlusRmarketing.co LLC<\/strong><br \/><strong>Effective Date:<\/strong> August 31, 2026<br \/><strong>Last Updated:<\/strong> August 31, 2026<\/p><ol><li><strong> Acceptance of Terms<\/strong><\/li><\/ol><p>By accessing or using the website <a href=\"https:\/\/eplusrmarketing.co\/\">https:\/\/eplusrmarketing.co<\/a> (the \u201cSite\u201d) and any related services, platforms, APIs, or software provided by EPlusRmarketing.co LLC (\u201cCompany,\u201d \u201cwe,\u201d \u201cus,\u201d or \u201cour\u201d), including our Location Routing Number (LRN) dipping platform (collectively, the \u201cService\u201d), you (\u201cCustomer,\u201d \u201cyou,\u201d or \u201cyour\u201d) agree to be bound by these Terms of Service (\u201cTerms\u201d).<\/p><p>If you do not agree to these Terms, do not use the Service.<br \/>These Terms form a binding agreement between you and EPlusRmarketing.co LLC.<br \/>If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.<\/p><ol start=\"2\"><li><strong> Description of Service<\/strong><\/li><\/ol><p>We provide a cloud-native LRN dipping platform and related telecommunications data services that enable accurate call routing, least-cost routing (LCR), billing classification (interstate\/intrastate), and related functions within the North American Numbering Plan (NANP) covering the United States and Canada.<\/p><p>Access to the Service is generally provided on a monthly subscription basis under a separate order form, quote, or service agreement (\u201cOrder\u201d).<\/p><ol start=\"3\"><li><strong> Eligibility and Account Registration<\/strong><\/li><\/ol><ul><li>You must be at least 18 years old and capable of entering into a binding contract.<\/li><li>You must provide accurate, complete, and current information when creating an account or placing an Order.<\/li><li>You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.<\/li><li>You must notify us immediately of any unauthorized use of your account.<\/li><\/ul><ol start=\"4\"><li><strong> Subscription, Fees, and Payment<\/strong><\/li><\/ol><ul><li>The Service is offered primarily on a month-to-month subscription basis as described in your Order.<\/li><li>Fees are due in advance according to the billing cycle stated in your Order (typically monthly).<\/li><li>All fees are non-refundable except as expressly stated in these Terms or required by law.<\/li><li>We may change pricing with at least 30 days\u2019 prior notice. Continued use after the notice period constitutes acceptance of the new pricing.<\/li><li>Late payments may result in suspension or termination of access and may incur late fees or interest at the maximum rate permitted by law.<\/li><li>You are responsible for all applicable taxes.<\/li><\/ul><ol start=\"5\"><li><strong> License and Acceptable Use<\/strong><\/li><\/ol><p>Subject to these Terms and your timely payment of fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service solely for your internal business purposes related to telecommunications routing and billing.<\/p><p><strong>You agree not to:<\/strong><\/p><ul><li>Use the Service for any illegal purpose or in violation of any applicable telecommunications, privacy, or data-protection laws (including U.S. and Canadian regulations).<\/li><li>Reverse engineer, decompile, disassemble, or attempt to discover the source code or underlying data structures of the Service.<\/li><li>Resell, sublicense, or provide the Service (or LRN data obtained through it) to third parties without our prior written consent.<\/li><li>Overwhelm or interfere with the Service (including excessive API calls beyond agreed limits).<\/li><li>Use the Service to build a competing product or service.<\/li><li>Misrepresent the origin or accuracy of data obtained from the Service.<\/li><\/ul><ol start=\"6\"><li><strong> Data and Intellectual Property<\/strong><\/li><\/ol><ul><li><strong>Your Data<\/strong>: You retain ownership of any data you submit to the Service. You grant us a limited license to process that data solely to provide the Service.<\/li><li><strong>Our Data &amp; Platform<\/strong>: We (and our licensors) retain all right, title, and interest in the Service, the LRN data, software, documentation, and all related intellectual property. No rights are granted except as expressly stated.<\/li><li>LRN data is provided for your authorized use only and may not be redistributed, republished, or used to create derivative databases without our written permission.<\/li><\/ul><ol start=\"7\"><li><strong> Service Availability and Support<\/strong><\/li><\/ol><ul><li>We strive to maintain high availability but do not guarantee uninterrupted or error-free Service.<\/li><li>Scheduled maintenance will be communicated when reasonably possible.<\/li><li>Support is provided according to the level described in your Order or as otherwise agreed.<\/li><\/ul><ol start=\"8\"><li><strong> Disclaimer of Warranties<\/strong><\/li><\/ol><p>THE SERVICE IS PROVIDED \u201cAS IS\u201d AND \u201cAS AVAILABLE.\u201d<br \/>TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.<\/p><p>We do not warrant that LRN data will be 100% accurate or complete at all times, as underlying industry databases may contain delays or errors.<\/p><ol start=\"9\"><li><strong> Limitation of Liability<\/strong><\/li><\/ol><p>TO THE MAXIMUM EXTENT PERMITTED BY LAW:<\/p><ul><li>OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.<\/li><li>WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR COST OF COVER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.<\/li><\/ul><p>Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.<\/p><ol start=\"10\"><li><strong> Indemnification<\/strong><\/li><\/ol><p>You agree to indemnify, defend, and hold harmless EPlusRmarketing.co LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys\u2019 fees) arising out of or related to: (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any law or third-party rights.<\/p><ol start=\"11\"><li><strong> Term and Termination<\/strong><\/li><\/ol><ul><li>These Terms remain in effect while you use the Service.<\/li><li>Either party may terminate a monthly subscription with written notice according to the terms of the Order (or, if not specified, at the end of the then-current monthly billing period).<\/li><li>We may suspend or terminate your access immediately for non-payment, material breach, or suspected misuse.<\/li><li>Upon termination, your right to use the Service ends and you must cease all use of any LRN data obtained through the Service (except data already incorporated into your historical records in the ordinary course of business).<\/li><\/ul><ol start=\"12\"><li><strong> Governing Law and Dispute Resolution<\/strong><\/li><\/ol><p>These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.<\/p><p>Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to personal jurisdiction there.<\/p><ol start=\"13\"><li><strong> Changes to These Terms<\/strong><\/li><\/ol><p>We may update these Terms from time to time. We will post the revised version on the Site and update the \u201cLast Updated\u201d date. Material changes will be communicated by email or through the Service when reasonably practicable. Continued use after changes become effective constitutes acceptance.<\/p><ol start=\"14\"><li><strong> Miscellaneous<\/strong><\/li><\/ol><ul><li><strong>Entire Agreement<\/strong>: These Terms, together with any Order and Privacy Policy, constitute the entire agreement between you and us.<\/li><li><strong>Severability<\/strong>: If any provision is found unenforceable, the remaining provisions remain in full force.<\/li><li><strong>Assignment<\/strong>: You may not assign these Terms without our prior written consent.
